These Terms and Conditions (“Terms”) form a legally binding agreement between you and Unearthed Nutrition (ABN 77 961 424 476) (“we”, “us”, “our”).
If you are under the age of 18, a parent or legal guardian must review and agree to these Terms on your behalf, and any reference to “you” includes your parent or guardian where applicable.
By booking a consultation, engaging us for group or corporate services, purchasing any products, or otherwise using our services (together, the Services), you agree to be bound by these Terms and any additional policies or guidelines provided by us from time to time. Please read them carefully.
1. Your Responsibilities
1.1 Client obligations
You agree to:
a) attend scheduled consultations, sessions, or services on time;
b) act respectfully and courteously toward practitioners, staff, and other participants;
c) complete all intake, consent, and follow-up documentation accurately and honestly, including disclosure of relevant medical conditions, allergies, intolerances, medications, supplements, pregnancy or breastfeeding status, and dietary preferences;
d) be at least 18 years old, or accessing the Website under the supervision of a parent or legal guardian, to purchase services or products offered on this Website;
e) notify us of any material changes to your health, circumstances, or information provided;
f) follow all reasonable health, safety, and participation guidelines;
g) engage with our Services in good faith; and
h) comply with all applicable laws and these Terms.
1.2 Overseas clients
If you are located outside Australia, you are responsible for ensuring that any products, supplements, or materials can be lawfully imported into your jurisdiction. We are not responsible for delays, restrictions, or seizures imposed by customs or regulatory authorities.
1.3 Right to refuse or discontinue Services
We reserve the right to refuse, suspend, or discontinue Services where you fail to comply with these Terms or where continued provision is not appropriate.
2. Fees and Payment
2.1 Orders and bookings
All bookings and orders are subject to acceptance and availability. A booking or sale is not confirmed until accepted by us.
2.2 Third-party providers
Some products or services may be supplied or fulfilled by third-party providers. In such cases, you may also be subject to their terms and conditions, which you agree to comply with.
2.3 Fees
Fees for consultations, group services, workshops, catering, or products are published on our website or communicated in writing. All prices are in Australian dollars unless stated otherwise. GST will be applied where required by law. Fees may change with notice.
2.4 Payment terms
Payment must be made in accordance with the terms specified at the time of booking or purchase. Failure to pay may result in cancellation of Services.
3. Warranties, Refunds, and Liability
3.1 Product issues
If you purchase products directly from us and they are damaged, incorrect, or incomplete, you must notify us within 7 days of receipt. Proof of purchase is required. Return postage and insurance are your responsibility.
Where products are purchased through third-party suppliers, you must contact the supplier directly.
3.2 Consumer guarantees
Nothing in these Terms excludes your rights under the Australian Consumer Law. You may be entitled to a refund, replacement, or compensation for a major failure.
3.3 Delivery and risk
Risk passes to you once goods are handed to the carrier.
3.4 Refunds
Refunds are only provided where required by law or where we are unable to supply Services. Change-of-mind refunds are not offered.
3.5 Allergies and contraindications
Some products or foods may contain allergens or may not be suitable for certain health conditions, pregnancy, or breastfeeding. It is your responsibility to review information and seek appropriate advice. We are not liable for allergic or adverse reactions.
3.6 No guaranteed outcomes
Health and wellbeing outcomes vary between individuals. We do not guarantee specific results from our Services.
3.7 Limitation of liability
To the maximum extent permitted by law, our liability is limited to the resupply, replacement, or refund of the relevant Services or products.
3.8 Indemnity
You agree to indemnify and hold harmless Unearthed Nutrition from and against any claims, losses, damages, liabilities, costs, or expenses arising out of or in connection with:
a) your breach of these Terms;
b) any information you provide that is inaccurate, incomplete, or misleading;
c) your failure to follow professional, medical, or nutritional advice appropriately; or
d) your use or misuse of the Website or Services.
4. Intellectual Property
All intellectual property associated with our Services, including written materials, treatment plans, educational content, recipes, guides, and resources, remains our property.
You may use these materials for personal purposes only. You must not copy, reproduce, distribute, or commercialise them without our prior written consent.
5. Confidentiality
You agree not to share, reproduce, or distribute our proprietary materials without permission. This does not prevent you from sharing recommendations with your GP or other healthcare professionals involved in your care.
6. Consultations and Cancellations
Consultations may be delivered online or in person, as agreed.
A minimum of 24 hours’ notice is required to reschedule or cancel an appointment.
Cancellations with less than 24 hours’ notice or failure to attend may incur a 50% cancellation fee.
If we need to cancel a session, we will notify you promptly and refund any fees paid.
7. Disclaimer
Our Services are provided by qualified nutrition professionals within their scope of practice. However:
Our Services do not replace medical advice, diagnosis, or treatment.
You are encouraged to discuss recommendations with your GP or relevant healthcare provider.
You remain responsible for your own health decisions.
If you are experiencing a medical emergency or serious symptoms, you must seek immediate medical care.
8. General
Privacy
We collect and manage personal information in accordance with our Privacy Policy.
Force majeure
We are not liable for delays or failure to perform due to events beyond our reasonable control, including natural disasters, pandemics, or supply chain disruptions.
Governing law
These Terms are governed by the laws of New South Wales, Australia.
Entire agreement
These Terms constitute the entire agreement between you and us and supersede any prior discussions or representations.
